The Platform Workers Directive (2024) directly addresses this:


It creates a presumption of employment for platform workers,


Grants access to algorithmic transparency,


Requires human oversight of automated decisions that affect employment status or income.



This makes the EU the first jurisdiction to legally regulate AI management systems in labor relations.

GDPR and Automated Decision-Making in Employment


The General Data Protection Regulation (GDPR) already provides important safeguards relevant to AI-driven workplaces.

Article 22 of the GDPR grants individuals the right not to be subject to a decision based solely on automated processing that significantly affects them, including in hiring, promotion, or dismissal.

Human involvement in final employment decisions,

The forthcoming AI Act strengthens this accountability by classifying AI used in employment and recruitment as “high-risk.” Providers of such systems must perform conformity assessments, risk management, and human-rights impact checks before deployment.

As remote and hybrid work expand, employers increasingly deploy AI-based monitoring tools to track performance, attendance, or even emotional tone.
