AI systems posing limited risk, such as chatbots or emotion-recognition tools, are primarily subject to transparency obligations. Minimal-risk applications, including many consumer-facing AI tools, remain largely unregulated, preserving space for innovation and experimentation.

The AI Act establishes a comprehensive compliance lifecycle for regulated systems, particularly those classified as high-risk. Providers bear the primary responsibility, even when systems are developed outside the EU but placed on the EU market or used within the Union.

Key obligations include conformity assessments prior to market entry, continuous quality management systems, and mechanisms for logging and traceability. Importantly, the Act recognises the complexity of AI value chains by allocating specific responsibilities to importers, distributors, and deployers.

Small and medium-sized enterprises are formally taken into account through proportionality measures, regulatory sandboxes, and guidance mechanisms. Nevertheless, compliance costs are expected to be significant, raising concerns about barriers to entry and competitive dynamics within the internal market.


5. Governance and Enforcement Architecture

To ensure consistent application across Member States, the AI Act introduces a multi-level governance structure. National competent authorities are responsible for enforcement at domestic level, while coordination is ensured through a newly established European-level body.

The European Artificial Intelligence Board plays a central role in fostering uniform interpretation, issuing opinions and recommendations, and facilitating cooperation between national authorities. The Court of Justice of the European Union remains the ultimate arbiter of interpretation, ensuring that the AI Act is applied consistently with EU primary law and fundamental rights.

Sanctions for non-compliance are intentionally severe, with administrative fines calibrated to mirror those under the GDPR. This reflects a deliberate policy choice: meaningful enforcement requires penalties that are capable of influencing the behaviour of large technology providers.

Much like EU data protection law, the AI Act has significant extraterritorial implications. Providers established outside the EU may fall within its scope if their AI systems are placed on the EU market or affect individuals within the Union. This “Brussels Effect” is likely to encourage global companies to align their AI governance practices with EU standards, potentially shaping international norms.

The Act also positions the EU as a key actor in global AI governance debates, influencing discussions in international organisations and bilateral trade negotiations. While some critics argue that stringent regulation may hamper competitiveness, others see the AI Act as a blueprint for trustworthy AI that could enhance long-term adoption and public trust.


7. Fundamental Rights and Democratic Values

A defining feature of the AI Act is its explicit integration of fundamental rights considerations. Risk management obligations are closely linked to the protection of human dignity, non-discrimination, privacy, and effective judicial remedies. By embedding these values into technical and organisational requirements, the Act moves beyond abstract rights discourse and translates constitutional principles into operational compliance duties.

Rapid technological developments, particularly in general-purpose and generative AI, test the adaptability of a framework built on predefined risk categories. Effective enforcement will depend heavily on the technical expertise and resources of national authorities.

Moreover, the interaction between the AI Act and existing liability regimes, including emerging reforms in product liability and civil responsibility, remains a complex and evolving area. Businesses and public bodies alike will need to adopt integrated compliance strategies that address overlapping regulatory requirements.
